19.02.2008 - Czech minister to lose power to pospone extradition - Court

The Constitutional Court abolished, on its own initiative, a part of the Penal Code that enabled the justice minister to postpone the extradition of suspects abroad until criminal proceedings against them in the Czech Republic are finished. The decision will take effect on December 31 this year. Courts can remand suspects in extradition custody when a foreign country asks for their extradition and who are likely to escape unless detained. Under the present law, the justice minister can postpone the extradition of a suspect if he or she is prosecuted in the Czech Republic at the same time. The aim of the present law is to give preference to sentencing for crimes committed in the Court to deal with first part of Czech reform complaint on Jan 31 ...

Czech Republic. The Constitutional Court started to deal with the issue after it received a complaint by a man who faced an accusation for people smuggling in Germany while at the same time he was being prosecuted in the Czech Republic. Then justice minister Pavel Nemec extended the man's extradition custody in 2005.
