The businessmen have been accused of trying to bribe Marcela Urbanova, Cunek's secretary when he was mayor of Vsetin, north Moravia, into changing her testimony against him. Cunek was suspected of having accepted in 2002, when he was Vsetin mayor, a half a million bribe from the H&B Real company for the sale of the town's majority stake in the Vsetinske byty housing company. It was, however, definitively halted a fortnight later and Cunek returned to the centre-right government of Mirek Topolanek (Civic Democrats, ODS) in April. Cunek confirmed to Pravo today that he really filed the complaint against Barborik. "I firmly believe that Barborik's attitude towards is not a decent conduct of a judge," Cunek told Pravo. Pravo writes that Cunek also resents the fact that Barborik has requested Cunek's file while working on the case of Vaskuj. According to a Pravo source, Cunek said in his complaint addressed to the Prerov District Court that he would no longer testify in the case. On Thursday, the Prerov District Court adjourned the case of Vaskuj and Smirak for an indefinite period because it needs more evidence, Barborik told CTK. He said it was necessary to question another four witnesses, including Cunek who in the past refused to testify in the case. In May, the court fined Cunek 20,000 crowns for his refusal to give witness's evidence in the case, citing his senatorial mandate. ($1=15.479 Czech crowns)
